Elora Legion and township facing $850K lawsuit

A Waterloo woman and her adult children are seeking $850,000 after slipping outside the legion, leaving her with a concussion and out of work for nearly a year

ELORA – The Elora Legion and Township of Centre Wellington are named in a slip and fall lawsuit that claims left a woman with  “serious personal injuries.”

A Waterloo woman, along with her two adult children, are seeking at least $850,000 in damages from the March 2023 incident that happened while she was walking towards the entrance of the Elora Legion branch according to a statement of claim filed in Kitchener in January. 

The claim said on March 29, 2023 the woman was walking on James Street in Elora towards the entrance on that street when she suddenly and without warning slipped on ice and fell, hitting the back of the head. 

The claim said she suffered serious personal injuries including a hematoma on the back of her head and a concussion. The woman has undergone various medical and rehabilitation treatments and more is expected in the future.

None of the claims have been tested in court and no statements of defence have been filed.

“As a result of her injuries, the plaintiff has experienced severe headaches, vestibular and sensory issues, neck and jaw pain, dizziness and nausea,” the claim stated. 

The woman has been off work from her job at Conestoga College since the injury, the claim said, her “social and recreational activities have been curtailed and her enjoyment of life diminished.”

The claim said the woman and her children are suing for pecuniary and non-pecuniary damages due to negligence of the Elora Legion and Township of Centre Wellington from preventing this incident through inspection, using salt or de-icer or maintenance, permitting a dangerous condition to exist and failing to give adequate warning about the condition of the area.

Derek Bowers, Elora Legion president, declined to comment on this story on behalf of the branch. 

“As you are aware, this matter is currently before the courts and as such we are not at liberty to discuss publicly,” Bowers said in an email.

The Township of Centre Wellington did not immediately respond to a request for comment but its usual practice is to not comment on court matters.
